The Parliament of South Australia recently passed the Return to Work (Employment and Progressive Injuries) Amendment Act 2024, with most of the changes expected to come into effect on 1 December 2024.

In Marthenis v Return to Work Corporation of South Australia [2024] SASCA 104, Mr Marthenis sought permission to appeal the decision of the Full Bench of the South Australian Employment Tribunal based on three questions of law. However, the Court of Appeal refused leave to appeal as none of the questions had been properly raised in the appeal and were not errors of law in any event.
